Covid-19 Lockdown

Daimler Trucks and Buses Southern Africa (Pty) (“DTBSA”) have always taken great social responsibility: We work for all who keep the world moving. Trucks and buses are the backbone of business and society.

Our social responsibility is being put to the test because of the spread of the Coronavirus. We now have to bring two disparate things together:

On the one hand, our original mission is particularly important in this current situation. Because right now the world is depending on our commercial vehicles to keep rolling -- to guarantee the food supply, bring necessary medications and even transport sick people.

DTBSA, like all other companies in South Africa, is affected by the epidemic spread of Covid-19. The consequences affect both our employees, suppliers and customers. We have strived to keep our business running in order to minimize the effects for everyone involved.

DTBSA have taken appropriate precautions to prevent and inhibit the contagion COVID-19, with relation to customers, employees and suppliers. In doing so we are following the latest information from the World Health Organization (WHO), the specific regulations gazetted by the legislature of the Republic of South Africa, and the precautionary measures being proposed by Daimler AG.

Moreover, the effect of COVID-19 and the restrictive measures have been exacerbated, firstly, by the declaration of COVID-19 as a national disaster in South Africa, and thereafter, by His Excellency President Cyril Ramaphosa, on 23 March 2020, announcing the National Coronavirus Command Council’s decision to enforce a nation-wide lockdown in terms of the Disaster Management Act, 2002, for a period of 35 (thirty-five) days with effect from midnight on Thursday, 26 March 2020, until further notice is issued (the “Lockdown”).

Based on Lockdown and subject to the Regulations published by Government, DTBSA hereby notifies you of Force Majeure, that for reasons that could not have been envisioned and which are beyond DTBSA’s reasonable control, DTBSA will unavoidably be delayed or obstructed in the performance of its obligations in terms of the warranty and maintenance agreements applicable to your vehicle from midnight 26 March 2020 to such date as the restrictive measures imposed globally in the wake of COVID-19 are relaxed and/or abandoned, and the Lockdown ceases to be imposed.

This notification, and the contents thereof are subject to any pronouncements contained in any such regulations gazetted by the legislature, to the effect that any of DTBSA’s obligations are required to continue to be discharged notwithstanding the Lockdown.

Notwithstanding the above, please be assured that DTBSA will expend its best efforts, to the extent that it is reasonably capable and/or permitted to do so by law or otherwise, to ensure that the operation of the Agreements continues unhindered and will exercise due diligence in doing so.
